Who Can Open a Health Professional Service Unit?

Within the scope of this Regulation;
clinical psychologists, dietitians, physiotherapists, audiologists, nurses, midwives, language and speech therapists, podologists and occupational therapists, their professions data-start="633" data-end="668">can open a healthcare professional service unit to operate independently

Legal entities cannot open a health professional service unit. A maximum of three healthcare professionals with the same title can jointly open a unit.


What are the Conditions for Opening a Health Professional Service Unit?

In order to open a health professional service unit;

  • Being a Turkish citizen

  • Having the authority to practice the profession freely

  • Getting a license from the Provincial Health Directorate

  • To ensure physical, technical and service standards specified in the Regulation

mandatory.


Documents Required for License Application

License application for the opening of a health professional service unit is made to the relevant Provincial Health Directorate. In the application;

How Does the Health Professions Service Unit Opening Process Progress?

  1. License application to the Provincial Health Directorate

After the license is obtained, the licenses of units that do not become operational within 6 months will be cancelled.


Physical and Technical Standards

In health professional service units;

It is mandatory.

All medical devices must be registered with the Ministry of Health Product Tracking System (ÜTS).


Service Delivery and Working Principles

Healthcare professionals;

  • Can only provide services within the scope of their professional competence

  • Can provide service to patients with a physician diagnosis and treatment plan

  • Must obtain informed consent

  • Responsible for ensuring patient privacy and data security

Unauthorized practices and diagnostic procedures are prohibited.


Registration, Archive and Digital Health Infrastructure Obligation

All health services offered;

  • Must be recorded electronically

  • A Health Information Management System registered to the Ministry's registration system should be used

  • Personal health data must be stored in accordance with KVKK and relevant legislation

Records signed with electronic signature are official documents.


Remote Health Services and e-Health Infrastructure

In order to provide remote health services in accordance with the legislation, the digital infrastructure used must be compatible with the Ministry of Health systems.

REGULATION ON EXECUTIONv

CHAPTER ONE

Preamble Terms

Purpose

ARTICLE 1-(1) The purpose of this Regulation is to regulate the procedures and principles regarding the health professional service units to be opened by healthcare professionals for the practice of self-employment, and the medical and technical standards of these units, their opening, activities, inspections and closure.

Scope

ARTICLE 2-(1) This Regulation covers healthcare professional service units and healthcare professionals and other personnel working in these units.

Base

ARTICLE 3-(1) This Regulation; Article 50 and additional 13 of the Law on the Proper Practice of Medicine and Medical Sciences No. 1219 dated 11/4/1928, Article 5 of the Nursing Law No. 6283 dated 25/2/1954, Article 3 and Article 9 of the Health Services Fundamental Law No. 3359 dated 7/5/1987 Clause (c) has been prepared based on the additional articles 11 and 19 and the 355th article of the Presidential Decree No. 1 on the Presidential Organization.

Definitions

ARTICLE 4-(1) In this Regulation;

a) Ministry: Ministry of Health,

b) Directorate: Provincial health directorate,

c) Health professional service unit: Private health institution where healthcare professionals practice their profession freely,

ç) Healthcare professional: Clinical psychologist, nurse, health officer equivalent to nursing, midwife, physiotherapist, audiologist, dietitian, language and speech therapist, podologist and occupational therapist (ergotherapist),

refers to.

CHAPTER TWO

Licensing Procedures

Persons who can open a health professional service unit

ARTICLE 5-(1) Health professional service unit is opened by Turkish citizen healthcare professionals who have the right and authority to practice their profession freely. Legal entities cannot open a health professional service unit.

(2) A joint healthcare professional service unit can be opened by a maximum of three healthcare professionals with the same title. In this case, a separate license document is issued for each healthcare professional and there are separate practice rooms that meet the physical standards specified in Article 11. Healthcare professionals are jointly responsible for the common areas in the joint healthcare professional service unit.

Licence application

ARTICLE 6-(1) It is mandatory to obtain a license certificate in order to open a health professional service unit. License application is made to the relevant directorate with the documents in ANNEX-1.

(2) If there is a deficiency or non-conformity in the application document, the applicant is notified within 10 business days and 30 business days are given to correct the deficiency or non-conformity. If the deficiency or non-conformity is not corrected, the application file is returned to the applicant.

(3) If it is determined that there are no deficiencies or non-conformities in the application documents, an on-site examination will be carried out by the commission to be formed by the directorate, within 30 working days from the date of application, in accordance with the Health Professions Service Unit Audit, Inquiry and Administrative Sanction Form in ANNEX-5.

(4) The commission to be formed by the Directorate; It consists of at least three people in total, depending on the service to be provided by the health professional service unit, preferably at least one person from the same profession.

(5) If deficiencies or nonconformities are detected as a result of the on-site inspection, the detected deficiencies or nonconformities are notified to the applicant. A period of 30 business days is given to correct the deficiency or nonconformity. Once the applicant notifies the directorate that the deficiency or non-conformity has been corrected, a new on-site examination is carried out.

(6) As a result of the examinations, if it is determined that there are no deficiencies or non-conformities, the license certificate in ANNEX-2 is issued.

Transfer ban and relocation of the health professional service unit

ARTICLE 7-(1) Health professional service unit license is non-transferable.

(2) If the health professional service unit wants to move to another address, the health professional service unit license application process must be done again.

Suspension of activity and cancellation of license

ARTICLE 8-(1) The license of the health professional service unit that does not become operational within 6 months from the issuance of the license certificate shall be cancelled.

(2) Upon the request of the license holder, the activities of the health professional service unit may be suspended for a maximum of 6 months, and if the activity is not started at the end of the period, the license of the health professional service unit will be cancelled.

(3) The activities of the health professional service unit may be suspended for a maximum of 2 years due to force majeure such as natural disaster, epidemic disease, decision on effectiveness for general life, declaration of mobilization. The license of a health professional service unit that is not operational at the end of the period is cancelled.

(4) If one of the license holders in joint healthcare professional service units leaves, the license issued in the name of the departing healthcare professional is cancelled.

(5) In case the activities of the health professional service unit are terminated, all documents and archive records issued on behalf of the health professional service unit and the drugs kept are delivered to the directorate within 10 business days.

Change in license information

ARTICLE 9-(1) If the address information of the health professional service unit is changed by the relevant municipality, an application is made to the directorate with the document and request petition received from the municipality. In this case, the license certificate is re-issued without charging the document fee.

(2) If there is a change in the matters included in the license certificate of the health professional service unit, the change must be notified to the directorate within 10 business days at the latest.

CHAPTER THREE

Physical Standards

Building condition

ARTICLE 10-(1) Health professional service units can be established in detached buildings or in an independent part of the buildings so that the areas where health services are provided are integrated.

(2) All areas used by patients and staff in healthcare professional service units are properly ventilated and adequately illuminated.

(3) Healthcare professional service units are air-conditioned with heating and cooling systems that enable to keep the temperature at an appropriate level.

Spatial standards

ARTICLE 11-(1) The minimum mandatory departments in the health professional service unit are as follows:

a) For healthcare professionals, there is a practice room of at least 10 m2where professional practices will be performed.

b) It is mandatory to have a sink in the application room.

c) For audiologists; It is mandatory to have a quiet room/cabin with a minimum size of 3 m2, consisting of two soundproof, specially insulated, glassed partitions within the application room. The quiet room/cabin must comply with sound insulation criteria.

ç) Apart from the application room, there is a waiting room of minimum 8 m2. The waiting room can also be used as a secretary service area without restricting the space. For each additional treatment room to be created, 5 m2is added to the waiting room.

d) There is a toilet suitable for disabled use, which has a hand washing section and provides the necessary hygiene conditions, in a location connected to the waiting room. The doors of the toilets can be opened outwards or sliding.

(2) A maximum of two practice rooms can be provided for each healthcare professional.

(3) It is mandatory to have the medical devices and equipment listed in ANNEX-4 in healthcare professional service units.

(4) All medical devices to be kept within the scope of professional authorization in health professional service units must be registered with the Ministry of Health Product Tracking System.

(5) In health professional service units, diplomas and working documents, along with the license certificate, must be hung in a visible place.

(6) Deviations of up to 10% are allowed in the measurements regarding the minimum physical standards determined in this Regulation.

CHAPTER FOUR

Personnel Standards

Duties and responsibilities of healthcare professionals

ARTICLE 12-(1) The duties and responsibilities of the healthcare professional are as follows:

a) To carry out all procedures related to the opening and operation of the health professional service unit.

b) To ensure coordination with the directorate about the activities of the health professional service unit and to send the requested information, documents and data.

c) To notify the directorate about the personnel and physical changes to be made in the health professional service unit within 10 business days at the latest.

ç) To take the necessary administrative and technical measures, to ensure that all services to be provided in the health professional service unit are provided and maintained in accordance with the standards, and to carry out the necessary self-inspections.

d) To establish the registration and archive system of the health professional service unit and to ensure that the records are kept regularly and accurately.

e) To ensure that the records of those applying to the health professional service unit are kept in accordance with the legislation on the protection of personal data.

f) To present all kinds of information, documents and records requested during inspections and to show all physical areas in the health professional service unit.

g) To carry out the work required by his profession in addition to his administrative duties.

ğ) To regularly maintain or calibrate the devices in the healthcare professional service unit.

h) To plan the working days and hours of the health professional service unit and inform them to the directorate.

Employing personnel and issuing employment documents

ARTICLE 13-(1) Healthcare professionals may employ health technicians/technicians according to their fields of activity. The number of health technicians/technicians to be employed cannot be more than one and a working certificate in ANNEX-3 is issued for the personnel. This provision is applied to clinical psychologists by employing psychologists.

(2) Support personnel can be employed to carry out the support services needed in the health professional service unit. Support personnel cannot be assigned to provide health services.

(3) If the personnel employed within the scope of the first paragraph leaves the job for any reason, the resignation information is notified to the directorate within 10 business days from the date of departure of the personnel and the employment certificate is canceled by the directorate.

Operating hours and notification

ARTICLE 14-(1) Working hours of health professional service units are specified in the license document.

(2) The working days and hours of all personnel working in the health professional service unit are notified to the directorate.

(3) It is mandatory to notify the directorate in cases of leave or illness in which healthcare professionals cannot actually be present in the healthcare professional service unit. In this case, health services cannot be provided in the health professional service unit. In health professional service units opened jointly by the same professional group, other health professionals continue to provide services in the practice rooms allocated to them.

ID card

ARTICLE 15-(1) Healthcare professionals and personnel; They carry their photo ID cards containing their name, surname and title in a visible manner.

CHAPTER FIVE

Service Standards

Working principles

ARTICLE 16-(1) Healthy individuals and patients are provided with services limited to the professional powers of the healthcare professional included in the Law No. 1219 and the Regulation on Job and Job Descriptions of Healthcare Professionals and Other Professionals Working in Health Services published in the Official Gazette No. 29007 dated 22/5/2014.

(2) In the health professional service unit, health services for sick individuals diagnosed by the relevant physician must be provided in accordance with the following conditions:

a) The patient, whose diagnosis has been made by the relevant physician and whose treatment plan or prescription has been prepared, applies to the health professional service unit.

b) When the patient applies to the healthcare professional service unit, registration to the system is carried out after the patient identity is verified. Patient information can only be viewed in the healthcare professional service unit where you are logged in, it cannot be transferred to another unit or system.

c) The healthcare professional who will perform the application checks the prescription or treatment plan, and does not apply it in cases where he foresees that the treatment plan will harm the beneficiary of the service.

ç) The healthcare professional informs the patient and, if necessary, the legal representative about the content of the procedure to be performed.

d) Written consent of the individual is obtained by filling out the informed consent form for each application.

e) The healthcare professional only performs the procedures included in the prescription or treatment plan and cannot perform any practice beyond his/her authority.

f) The healthcare professional creates a record detailing the procedures applied and keeps these records in accordance with the relevant legislation. The physician planning the treatment can view the treatment process records in accordance with the patient's consent.

(3) In the health professional service unit, health services are provided in a way that ensures patient safety and privacy.

(4) Health care services cannot be provided in health professional service units in the following cases:

a) Situations requiring medical intervention and advanced medical equipment.

b) Life-threatening acute and chronic conditions.

c) Conditions showing signs of systemic infection.

ç) Applications other than first aid in emergency situations such as injury, trauma or anaphylactic reactions.

d) Procedures requiring medical diagnosis.

e) Situations requiring all kinds of medical intervention that are beyond the authority and equipment of a healthcare professional.

(5) Healthcare professionals who practice their profession freely in healthcare service units cannot work in another healthcare institution.

First Aid

ARTICLE 17-(1) Healthcare professionals must attend first aid training determined by the Ministry.

(2) Healthcare professionals fulfill first aid requirements in line with the training they have received until emergency healthcare services are reached by authorized persons.

Record and archive

ARTICLE 18-(1) The data of patients applying to the health professional service unit and the prescription or treatment plan created by the physician are recorded electronically. It is mandatory to use a health information management system registered in the Ministry's registration system for recording and archiving data.

(2) Personal health data recorded by health professional service units are processed and transferred to the central health data system in accordance with the procedures and principles determined by the Ministry in accordance with the Personal Data Protection Law No. 6698 dated 24/3/2016 and Law No. 3359. It is mandatory to send the requested information and documents as a basis for the registration and notification system established by the Ministry and other works and transactions to be carried out by the Ministry.

(3) All services provided in health professional service units are recorded and maintained. These records are shared with the patient or his legal representative upon the patient's request.

(4) Medical records signed with an electronic signature in accordance with the provisions of the Electronic Signature Law No. 5070 dated 15/1/2004 are considered official records and are backed up and archived in accordance with the relevant legislation. Necessary administrative and technical measures are taken against physical, magnetic or electronic interventions and possible abuses to prevent the necessary records of patients' health information from being stored, changed or deleted electronically and to prevent confidentiality from being violated. The healthcare professional is responsible for taking the necessary administrative and technical measures in this regard and periodically inspecting them. Documents that must be kept in the file are kept separately.

(5) It is mandatory to submit all records kept during the audits to the relevant parties.

Signage standard

ARTICLE 19-(1) No other name, professional name or the phrase "expert" other than the name and title of the healthcare professional can be used on the signs and printed and electronic media materials of the healthcare professional service unit.

(2) The building exterior sign cannot be larger than 4 m2, and the sign on the building entrance doors cannot be larger than 40×60 cm. Apart from the sign to be placed on the exterior of the building, no other writings or signs can be placed for any purpose.

(3) The exterior sign contains the phrase "Private Health Professional Service Unit". The phrase “Special” is included in a text not less than half of the other font size.

(4) A maximum of two colors can be used on the exterior sign. Signboard texts are arranged plainly and without ornaments.

(5) Each room door has an internal sign clearly stating its intended use. Interior signs are arranged in readable sizes, simple and understandable. In joint healthcare professional service units, the signboard indicates which healthcare professional the practice rooms belong to.

(6) The academic title of the healthcare professional can be used in signs and printed and electronic media, provided that it is placed after the clearly written professional title and is written in the same size, font size and character.

(7) Health professional service units; It operates in accordance with the Corporate Identity Guide of the Ministry of Health in logos, signs, direction signs, official document formats, identity cards, building interior and exterior visuals, digital platforms and corporate correspondence.

(8) In order to prevent people from misperception and confusion in the printed and electronic media materials of the health professional service unit, expressions that may evoke public health institutions or organizations throughout the country, regardless of the province, cannot be used.

Patient rights, ethical and deontological principles

ARTICLE 20-(1) In the healthcare professional service unit, necessary measures are taken to effectively implement the legislation on patient rights in order to prevent violations of patient rights and problems that may arise due to them and to effectively use legal protection methods when necessary.

(2) It is mandatory to have an integrated QR code with the phrase "Ministry of Health Communication Center" where patients can give feedback, provided that it is visible in the waiting rooms of healthcare professional service units.

(3) Healthcare professionals are obliged to fulfill all their duties, powers and responsibilities within the framework of professional ethical rules and relevant legislation.

(4) Information and promotional activities to be carried out by the health professional service unit are carried out in accordance with the provisions of the Regulation on Promotion and Information Activities in Health Services published in the Official Gazette dated 29/7/2023 and numbered 32263. Healthcare professionals and staff cannot engage in promotions or advertisements that violate the rules of medical deontology and ethical principles, that mislead or mislead people, or that aim to create demand, and cannot engage in behavior that would create unfair competition against other healthcare institutions.

CHAPTER SIX

Prohibitions and Control

Prohibitions

ARTICLE 21-(1) A healthcare professional can only open one healthcare professional service unit. Except for the building where the licensed health professional service unit is located, it cannot be used as another place, health professional service unit or branch, in whole or in part.

(2) There cannot be a workplace for any other purpose within the health professional service unit. A section within it cannot be rented or transferred in any way to third parties to operate for another purpose.

(3) Any section or area in the health professional service unit cannot be used for purposes other than its intended purpose or by unauthorized persons.

(4) Except for the list of medical supplies and medicines used within the scope of professional authority, no medicine, medical equipment, cosmetic product, food supplement or similar product can be kept or sold.

(5) Medical devices, tools and equipment cannot be kept in the health professional service unit outside the scope of professional authorization and for purposes other than their intended use.

(6) In health professional service units, there cannot be rooms, cabinets, sections or similar closed spaces that cannot be shown during inspections.

(7) Individuals who apply to the health professional service unit regarding medical procedures that cannot be performed in health professional service units cannot be directed to health institutions, and no agreements can be made for this purpose.

(8) Individuals who apply to the health professional service unit cannot be asked to have examinations and analysis.

(9) Healthcare professionals cannot, under any circumstances, provide consultancy, training, coaching or healthcare services under any other name without a healthcare professional service unit licensed in their name.

(10) Healthcare professionals cannot provide healthcare services with licenses, authorization certificates and permits obtained from other institutions.

Audit

ARTICLE 22-(1) Health professional service units; In accordance with the provisions of the Regulation on the Inspection of Private Health Facilities published in the Official Gazette dated 17/11/2023 and numbered 32372, it is subject to ordinary inspection at least once a year according to the criteria specified in the Health Professional Service Unit Inspection, Inquiry and Administrative Sanctions Form in ANNEX-5.

(2) When necessary, an audit is carried out in order to determine the compliance of the health services provided in health professional service units with the medical indications or practices determined by the Ministry. Medical indication and application audit; It is done through the patient file, electronic recording systems, medical photographs/video/audio recordings, reports and other relevant information and documents, using the e-audit system or on-site.

(3) From health institutions and organizations belonging to the Ministry or universities to carry out medical indications and application inspections; A medical indication and practice audit commission consisting of at least three experts in the field, preferably academicians, is established with the approval of the Ministry or directorate. The duty and authority of the commission is limited to the relevant health service provision area and the determined audit period. The duration of the audit starts from the date of notification of the assignment approval to the relevant parties and ends with the approval of the submitted audit report.

(4) During the inspections, if urgent and irreparable situations arise that negatively affect the treatment of patients in the health professional service unit, endanger patient health and safety if the service continues, and require the service to be stopped immediately without delay, the activities of the health professional service unit are stopped by the Governorship upon the decision of the Ministry until the deficiency is corrected, provided that this situation is documented with the inspection report, stating the reasons.

CHAPTER SEVEN

Miscellaneous and Final Provisions

Situations for which there is no provision

ARTICLE 23-(1) In cases where there is no provision in this Regulation, other legislative provisions regarding the legislation governing private health institutions providing outpatient diagnosis and treatment shall apply.

Adjustment of existing organizations

PROVISIONAL ARTICLE 1-(1) For health cabins opened before the date of entry into force of this Regulation, the legislative provisions of the date of opening continue to apply in terms of physical standards. However, in terms of other standards, it is licensed by being brought into compliance with the provisions of this Regulation until 31/12/2025. At the end of this period, health cabins that do not comply with the provisions of this Regulation will be closed.

(2) The ownership and partnership status of health cabins opened before the effective date of this Regulation shall be preserved.

(3) Businesses opened by healthcare professionals and operating under various names before the date of entry into force of this Regulation must be brought into compliance with the provisions of this Regulation and licensed within 3 months at the latest from the date of entry into force of this Regulation.

Effectiveness

ARTICLE 24-(1) This Regulation shall enter into force on the date of its publication.

Execution

ARTICLE 25-(1) The provisions of this Regulation shall be enforced by the Minister of Health.
